Surefire Distribution & Services (Pty) Ltd, trading as SFDS. Registration number: 2020/154596/07.
Terms of Service
Prices are fixed as shown on the site and in your proposal. Proposals are valid for 14 days.
Scope: your proposal (the package or app, the ticked extras, add-ons and modules, and the feature list shown for them) is the complete scope of the work. What you write in the brief, notes, uploads or messages is information for the build, not extra scope. Anything not listed in your proposal is a change request.
What we build: SFDS builds websites and small apps and tools only. We do not build large or complex business systems. If an order turns out to be outside this scope, SFDS may cancel it and refund the deposit in full within 7 working days, and nothing more is owed by either side.
Timelines: all timelines are estimates in working days, counted from when all your content and account access are in. They are not guarantees, and a delay does not entitle you to a refund, discount or damages.
Limitation of liability: to the extent the law allows, SFDS's total liability for any claim about an order is limited to the fees you paid SFDS for that order. SFDS is not liable for indirect or consequential loss, such as lost profit, lost sales, lost data or business interruption, or for outages, price changes or rule changes of third-party providers (hosting, Supabase, PayFast, Yoco, Apple, Google, Meta, SMS and email providers). Nothing in these terms limits rights you have under the Consumer Protection Act that cannot be excluded.
Warranty: we fix defects in the agreed scope for 30 days after launch. Apart from that, and to the extent the law allows, SFDS gives no other warranty, including that a site or app will be error-free, always available or bring in a set amount of business.
Care plans: care plans are best effort. Backups and uptime checks depend on your hosting and providers, and SFDS does not guarantee uptime or that every backup can be restored. Care covers keeping the agreed scope working, not new features or redesigns.
Rush delivery: we start your project first and aim for a delivery time about 30% shorter once all content is in. If we miss that target because of a delay on our side, only the rush fee is refunded.
Your content: you confirm you have the right to use the text, photos, logos and data you send us, and you are responsible for your own products, prices, customer data and business. You agree to cover SFDS for claims caused by your content (final wording to be confirmed by an attorney).
Websites: 50% deposit to start, 50% before go-live. Ready-made apps: fixed price, 50% deposit to start, 50% before go-live. Custom apps: Planning Blueprint (R2,950) paid upfront. The Blueprint is a planning document only, not the software. The app build (builds from R25,000) is quoted separately and paid 50% deposit to start and 50% before go-live. The build quote is valid for 14 days and binds neither side until the build deposit is paid. If the Blueprint shows the project is bigger than a small app, SFDS declines the build and you keep the Blueprint. The Blueprint fee is credited against the build if the build quote is accepted within 60 days.
Work starts only when the deposit has cleared.
Content must be uploaded within 30 days of the deposit, or the project pauses.
Revision rounds: Starter 1, Business 2, Online Business 2, apps 2, under the revision rules below.
Support: 30 days after launch for defects in agreed scope, for websites and apps. App Care is optional at R1,150 a month and includes 1 hour. Every live app runs on a Supabase Pro plan on your own Supabase account, paid by you directly to Supabase. SFDS is never billed for it and never resells it. SFDS does not build auto-posting to social media, bulk WhatsApp marketing or anything that needs a Meta developer app. New features are not included.
You own your hosting, domain, payment and third-party accounts and pay those providers directly.
Database: your Supabase database is your own account, in your name, paid by you directly to Supabase. SFDS is never billed for it and never resells it. A Supabase Pro plan is required for every live app.
App store accounts, option A (own accounts, recommended): your app is published on your own Apple and Google developer accounts, either an individual account in the owner's name (the owner's name shows as the seller) or an organisation account in your company name (needs a D-U-N-S number). You pay Apple US$99 a year and Google US$25 once, directly. SFDS charges nothing for publishing. Optional: Our R950 account set-up service is our own fee for opening the accounts with you. It comes on top of the store fees and does not include them.
App store accounts, option B (SFDS accounts): your app is published on SFDS's Apple and Google accounts for R450 a month or R4,950 a year. App Care (R1,150 a month) is compulsory while the app is listed there. The store listing shows SFDS as the developer name. If hosting or App Care is unpaid for more than 14 days, SFDS may remove the app from the stores. Moving the app to your own accounts later costs R1,950.
Order limits: websites up to 15 pages, 15 pages of copywriting, 15 pages of content migration, 10 extra product packs and 10 variant packs; apps up to 5 extra location pages, 3 extra custom screens and 3 modules per order. Bigger projects need a Planning Blueprint.
Revisions: a revision round is one combined list of changes sent by email within 5 working days of the preview. Unused rounds lapse at go-live. Extra rounds cost R650 (websites) or R950 (apps).
Change requests: anything not in your proposal is a change request. Change requests cost R450 an hour (minimum 30 minutes), are quoted in writing first and are paid before work starts. Nothing is done on an unpaid change request, and SFDS may decline any change request.
Content: if your content is not uploaded within 30 days of the deposit, your project moves to the back of the queue and a R950 restart fee applies. After 90 days without content the project is closed, the deposit is kept and finished work is handed over as it is.
Abandoned projects: if we cannot reach you after 3 reminders over 30 days, the project closes. Files are kept for 90 days and then deleted. Reopening costs R950.
Go-live and final payment: we build on a test link. Nothing goes live on your domain or in the app stores until the balance has cleared. The licence to use our template code passes to you only on full payment. Unpaid balances: R350 late fee after 7 days, and a live site or app may be suspended until paid.
Chargebacks: a chargeback or payment reversal on work that was delivered is a breach of these terms. Work stops, access is suspended, the amount is recovered, and a R450 admin fee per chargeback applies. Your written approvals, messages and our logs are kept as evidence.
App stores: 2 resubmissions are included for rejections caused by us. Rejections caused by missing client content, policies, accounts or products not allowed by Apple or Google cost R950 per resubmission. Store review time is not part of our delivery time.
Accounts: all accounts (domain, hosting, Supabase, PayFast or Yoco, Apple, Google) are opened in your name, with SFDS added as admin. You keep the main logins. We remove our access on request. Our optional account set-up service costs R950. It is our own fee and does not include any fees charged by the account providers (for example Google Play US$25 once-off and Apple US$99 a year), which you pay to them directly.
Price lock: proposals are valid for 14 days. A paid deposit locks your price for up to 60 days of content delays.
Provider costs: bills, price changes and rule changes from providers (Supabase, Apple, Google, Meta, PayFast, Yoco, SMS and email providers) are yours. Supabase charges for usage above the Pro plan's included amounts, so your bill can vary. We recommend keeping Supabase's spend cap on (it is on by default); it does not cover a bigger server or add-ons. Apple and Google may take a commission on digital items sold inside a store app (for example memberships or vouchers); their rules apply, not ours.
POPIA: you are the responsible party for your customers' personal information. SFDS acts only as an operator, processing it on your instructions to build and maintain your system, and keeps it secure and confidential.
Licence: your template app is licensed for one business. Using it for another business needs a new licence at 50% of the app price.
Support and care: support covers defects in what you ordered only, not new features or training. Training beyond the included hour costs R650 an hour. Without App Care, fixes cost R450 an hour. Rejoining App Care starts with a R950 health check.
Optional extras: yearly OS and app store update pack R2,450 a year, priority 5-day launch R1,950 (once all content is in), data export and handover pack R1,450.
Refund Policy
Full deposit refund if SFDS cancels, or if you cancel before work has started.
Cooling-off: if you buy as an individual (not a company), the law (ECTA section 44) lets you cancel within 7 days of paying for a full refund. This does not apply once work has started with your consent within those 7 days (ECTA section 42).
Deposit is non-refundable once work has started.
Cancellation after work starts: we keep the deposit plus payment for milestones completed, as listed in your milestone emails (websites: the deposit covers design and build up to the preview link; apps: the deposit covers set-up and build up to the test link). Once you approve the preview, the full balance is due.
Planning Blueprint: you confirm delivery by replying to our delivery email. Disputes raised within 7 days of delivery are limited to correcting the document.
Closed or abandoned projects (no content after 90 days, or no reply after 3 reminders over 30 days) are not refunded.
Chargebacks are not a refund route. Please raise problems by email first.
Planning Blueprint fee (R2,950) is non-refundable once the Blueprint document has been delivered. The Blueprint is not the software, so no refund is due because an app was not built.
Privacy Policy (POPIA)
We collect only what is needed to deliver your project: name, email, business details, brief answers and files you upload.
Payments are processed by PayFast. We never see or store card details.
Each client can only access their own project data.
